Could it be a lawful adult not a child?

So a video (via youtube.com, link at end of post) was posted on my facebook timeline from fellow adult industry writer, N’jaila Rhee this evening.
It’s a news report about Lupe Fuentes (Lupe The Innocent) rescuing a fan from facing 20 years in prison for owning one of her videos. Not that it is illegal to have her videos, it’s that while the fan stopped in Puerto Rico customs thought the video featuring Fuentes was child porn.
Lupe, the adult talent is question not only looks young but in the title this man was transporting she was just 18 years old. While the government considers 18 a legal adult, it is very easy to find many 18 year old who look like underage girls still.
After being contacted via her myspace page, Lupe with the accompaniment of her manager Evan Seinfeld, packed up and traveled to P.R. just in time for the trial to free the fan from facing 20 years in prison. At this point the fan from New York, Carlos Simon-Timmerman, had already spent some 4 months in jail and 3 months on house arrest.
The court even had a line up of professional medical experts that said in no way could the actor in question on the video be over 12 years old (Lupe who was actually 18). It’s not hard to see why she was mistaken in age BUT what comes to light is the question; How many people have been in any legal troubles over “child porn” when in fact the talent of the photos/videos were actually of the legal age?
Will this lead to many appeals for offenders? Will there have to be legal notice on video content verifying ages of talent? I though there was always a legal notice on content to let you know age was verified and productions companies to contact if questions arose. So honestly I don’t understand why this even went this far in court.
I do feel a certain way about porn using just legal girls & dressing them up as children. I also have a personal opinion about the legal age being raised (I think of 18, 19 yr old as “teens” still) , but that’s a whole another post.
I DO applaud Lupe Fuentes and Evan Seinfeld for standing up at their own personal expense (travel costs, etc) for a fan and coming to his aid. That gives me more proof that talent does care about their fan base. Thanks for standing up for our rights Lupe & Evan.
